1. Acceptance of Terms
By accessing or using HeyNashi ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Service.
2. Service Description
HeyNashi is a meal planning and recipe management application that helps you organize weekly meals, manage recipes, and generate grocery lists. You can use the Service in your browser. A native iPhone app is in development; its availability is announced separately. You can share kitchen content with other accounts and optionally connect compatible assistants after authorizing access.
3. User Accounts
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account. You may not create multiple accounts or share your account with others. To use a shared kitchen, invite other people to participate with their own accounts rather than sharing your sign-in credentials.
4. Free Trial and Subscription
New users receive a 14-day free trial. No payment information is required to start the trial, and it does not automatically become a paid subscription. After the trial expires, paid access is required to continue using subscription features. The web subscription is billed annually. Available plans, prices and billing periods are shown before purchase; the iPhone app may offer different purchase options through the App Store.
5. Payments and Billing
Web payments are processed through RevenueCat and Stripe. Purchases in the iPhone app are processed by Apple through the App Store, with access managed through RevenueCat. The applicable price, currency, billing period and any renewal terms are shown before purchase. Recurring subscriptions automatically renew unless cancelled. One-time purchases, where offered, do not renew.
6. Cancellation and Refunds
You may cancel a web subscription through the subscription management portal. App Store subscriptions are managed in your Apple account. Upon cancellation, you retain access until the end of the current billing period. No prorated refunds are provided for partial billing periods, subject to mandatory statutory rights and the applicable store terms. Web refund requests for exceptional circumstances may be directed to our support email; App Store refunds are requested from Apple.
7. User Content
You retain ownership of content you create within the Service, including recipes, meal plans, and grocery lists. You grant HeyNashi a limited license to store, process, and display that content to provide the Service, including sharing it with people you invite and making it available to connected apps you authorize. We do not sell your content or use it for purposes unrelated to providing the Service.
8. Privacy and Data Protection
We collect and process personal data necessary to provide the Service, including your email address, profile information, and usage data. Your data is stored securely on servers within the European Union. We do not sell your personal data to third parties. You may request deletion of your account and associated data at any time by contacting us.
9. Service Availability and Warranties
The Service is provided "as is" without warranties of any kind, either express or implied. We strive to maintain high availability but do not guarantee uninterrupted or error-free service. We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice. Scheduled maintenance windows will be communicated in advance when possible.
10. Limitation of Liability
To the maximum extent permitted by applicable law, HeyNashi shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from your use of or inability to use the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the Service and cancel your subscription.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Germany.
